New York City FC defender Diego Martinez has been cleared of an accusation of using homophobic language during last Sunday’s match against D.C. United.

MLS has fined Martinez an undisclosed amount for using obscene language during the match.

Martinez had been accused of directing a homophobic slur at a ball kid by fans claiming to have overheard an exchange on the sidelines. MLS received the report earlier in the week and conducted interviews with witnesses and those involved on both sides. In its release, the league stated that it could not corroborate the initial report but did find that Martinez had directed an obscenity at the ball kid.

“MLS enforces a zero tolerance policy against any form of discrimination,” a league statement said. “The League, its clubs, players, fans and the MLS Players Union treat allegations of discrimination very seriously and are committed to creating an environment in which all individuals are treated with respect and dignity.  The League prioritizes the creation of an inclusive environment for all who attend our games, and insists that all stadiums are free of discrimination.”

NYCFC declined a request for comment.
